These Terms of Service ("Terms") govern your use of Total Control (the "Service"), operated by QC Webworks LLC ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 18 years old, have the authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of Service
Total Control is a marketing command center platform that provides:
Unified dashboard for managing WordPress sites, Google Ads, Microsoft Advertising, Google Analytics 4, and HubSpot CRM
Site health monitoring, uptime tracking, and performance analytics
AI-powered insights and cross-platform intelligence
Content management, SEO auditing, and visual feedback tools
White-label deployment capabilities for agencies
MCP (Model Context Protocol) integration for AI-assisted operations
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials
You must provide accurate and complete information during registration
You are responsible for all activity under your account
You must notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms
4. Subscription Plans & Billing
4.1 Plans
The Service is offered under the following tiers:
Free: Limited features for evaluation
Pro ($49/month): Full features for individual users
Agency ($149/month): Multi-client management and white-label
Enterprise (Custom): Custom pricing for large organizations
Feature availability varies by plan. We reserve the right to modify pricing with 30 days notice to active subscribers.
4.2 Billing
Paid plans are billed monthly or annually in advance
Payments are processed through our third-party payment provider
Failed payments may result in service suspension after a 7-day grace period
4.3 Refunds
We offer a 14-day money-back guarantee for first-time paid subscribers. After 14 days, fees are non-refundable. Downgrades take effect at the end of the current billing cycle.
5. Acceptable Use
You agree not to:
Use the Service for any illegal purpose or in violation of any applicable law
Attempt to gain unauthorized access to the Service, other accounts, or connected systems
Reverse engineer, decompile, or disassemble any part of the Service
Use the Service to send spam, phishing emails, or other unsolicited communications
Interfere with or disrupt the integrity or performance of the Service
Upload or transmit malicious code, viruses, or harmful data through the Service
Resell or redistribute the Service without an active Agency or Enterprise plan
Scrape, harvest, or collect data from the Service through automated means
Use the AI features to generate content that is illegal, harmful, or violates third-party rights
6. Connected Third-Party Services
The Service integrates with third-party platforms (Google Ads, Microsoft Advertising, GA4, HubSpot, WordPress). By connecting these services:
You authorize us to access and process data from these platforms on your behalf
You represent that you have the right to grant this access
You acknowledge that third-party services are governed by their own terms and privacy policies
We are not responsible for the availability, accuracy, or actions of third-party services
You may revoke access to any connected service at any time through the Integrations settings
7. WordPress Site Management
When you connect a WordPress site to the Service:
A child plugin is installed on your site to enable API communication
The Service can read, create, update, and delete content on your site as authorized by you
You are responsible for maintaining backups of your WordPress site
We are not liable for data loss resulting from actions taken through the Service on your site
8. AI-Powered Features
AI-generated insights, recommendations, and content are provided "as is" for informational purposes
You are solely responsible for reviewing and acting upon AI-generated outputs
We do not guarantee the accuracy, completeness, or suitability of AI-generated content
AI features should not be used as the sole basis for business decisions
9. Data Ownership & Intellectual Property
9.1 Your Data
You retain all rights to data you upload, connect, or generate through the Service ("Your Data"). We claim no ownership over Your Data. We use Your Data only to provide and improve the Service as described in our Privacy Policy.
9.2 Our Service
The Service, including its code, design, features, documentation, and branding, is owned by QC Webworks LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding except as enabled through white-label features on applicable plans.
9.3 White-Label
Agency and Enterprise plans may customize branding elements. You may not represent the Service as your own product in a way that is misleading or implies our endorsement without authorization.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
WE ARE NOT LIABLE FOR LOSSES RESULTING FROM ACTIONS TAKEN ON THIRD-PARTY PLATFORMS THROUGH THE SERVICE
11. Indemnification
You agree to indemnify and hold harmless QC Webworks LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
You may cancel your account at any time through the Settings page or by contacting support
We may suspend or terminate your account for violation of these Terms with notice
We may terminate the Service entirely with 90 days notice to active paid subscribers
Upon termination, your right to use the Service ceases immediately
Data deletion follows the timeline described in our Privacy Policy
13. Service Level
We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by factors outside our reasonable control, including third-party service outages, hosting provider issues, or force majeure events.
14. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance. If you disagree with changes, you may cancel your account before the changes take effect.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court for intellectual property violations.
16. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and QC Webworks LLC regarding the Service
Severability: If any provision is found unenforceable, the remaining provisions remain in full effect
Waiver: Failure to enforce any provision does not constitute a waiver of that provision
Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets
